Please note: these are the T&Cs for school students/users and facilitators.
On this page and in various sections of the website, www.entrepreleadersschool.co.za are set out the terms and conditions (“Terms”) on which you may access and make use of our website. These Terms constitute a binding legal agreement between you as the user (whether or not you are a Registered student, as defined below) and a facilitator at Entrepreleaders School registered under Entrepreleaders House Ltd, a company registered in South Africa with company number 2019/313981/07.
Please read these Terms carefully before you start to use the Entrepreleaders School website. By using this website, you indicate that you accept these Terms and that you agree to abide by them. If you do not agree to these Terms, please refrain from using the Entrepreleaders School website or any other Entrepreleaders related brand or product. You warrant that you have the right, authority and capacity to enter into and be bound by these Terms and that by using this website you will not be violating any law or regulation of the country in which you are resident. You are solely responsible for your compliance with all applicable local laws and regulations.
TERMS OF BUSINESS WITH ENTREPRELEADERS SCHOOL
In addition to the Terms set out elsewhere on our website, a student, facilitator or any other type of use of this site (via its authorised representative) shall agree to be bound to the following terms of business:
1. Definitions
In these Terms of Business:
‘Entrepreleaders School’ means Entrepreleaders House Limited.
‘student’ means a person who has shown interest or purchased any of the services available on this site.
‘Facilitator’ means the person or organisation within our school to whom a student is introduced and will be in charge of facilitating the course throughout the entire curriculum of an expedition.
“Expedition” refers to a specific module, subject or course within the curriculum
“Pod” refers to a group of students enrolled together for a period of 6 months
‘Regulations’ means the Conduct of Employment Agencies and Employment Business Regulations 2003 (as amended from time to time).
‘Terms of Business’ means these Employment Agency Terms of Business, any documents agreed or issued pursuant to the terms herein and any agreed variations.
Reference to the singular includes the plural and reference to the masculine includes any gender and vice versa.
ELS refers to Entrepreleaders School
ELF refers to Entrepreleaders Foundation
ELH refers to Entrepreleaders House as the umbrella company.
2. Terms of Use
These Terms of Use ("Terms") were last updated on July 20, 2021.
Entrepreleaders School’s mission is to empower African youth to take ownership of their lives by creating a job for themselves and their community at large through entrepreneurship and leadership learning otherwise called Entrepreleadership. We enable any youth anywhere with a focus on Africa to create innovative and solution-driven organizations capable of stimulating economic growth around Africa. We consider our marketplace model the best way to offer valuable entrepreneurial & educational content to our users. We need rules to keep our platform and services safe for you, us, and our student and facilitators community. These Terms apply to all your activities on all Entrepreleader website and related services.
Students and must be at least 18 years of age to create an account on Entrepreleaders and use the Services. If you are younger than 18 but above the required age for consent to use online services where you live (for example, 13 in the US or 16 in Ireland), you may not set up an account without your parent or guardian; we encourage you to invite a parent or guardian to open an account and help you access content that is appropriate for you. If you are below this age of consent to use online services, you may not create a Udemy account. If we discover that you have created an account that violates these rules, we will terminate your account. You may be requested to verify your identity before you are authorized to submit content and become an ELS student.
You can terminate your account at any time but your payment for any ongoing service may carry on until the end of the purchased product cycle.
3. Content Enrollment and Lifetime Access
When you enroll in an expedition or other content, you get access to our services. Don’t try to transfer or resell the content in any way. We generally grant you lifetime access, except when we must disable the content because of legal or policy reasons or for enrollments via Subscription Plans.
When facilitators publish content on ELS, they grant ELS a license to offer a license to the content to students and the content published becomes property of ELS. This means that we have the right to sublicense the content to enrolled students without the permission of its originator. As a student, when you enroll in a course or other content, whether it’s free or paid content, you are getting access to view the content via the Entrepreleaders School platform and Services, and Entrepreleaders School is the licensor of record. Content is licensed, and not sold, to you. This license does not give you any right to resell the content in any manner (including by sharing account information with a purchaser or illegally downloading the content and sharing it on torrent sites).
In legal, more complete terms, Entrepreleaders School grants you (as a student) a limited, non-exclusive, non-transferable license to access and view the content for which you have paid all required fees, solely for your personal, non-commercial, educational purposes through the Services, in accordance with these Terms and any conditions or restrictions associated with the particular content or feature of our Services. All other uses are expressly prohibited. You may not reproduce, redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, create derivative works of, sublicense, or otherwise transfer or use any content unless we give you explicit permission to do so in a written agreement signed by a Udemy authorized representative.
We generally give a lifetime access license to our students when they enroll in an Expedition or other content. However, we reserve the right to revoke any license to access and use any content at any point in time in the event where we decide or are obligated to disable access to the content due to legal or policy reasons, for example, if the course or other content you enrolled in is the object of a copyright complaint, or if we determine it violates our trust and safety guidelines explained here. This lifetime access license does not apply to enrolments via Subscription Plans or to add-on features and services associated with the course or other content you enroll in. For example, facilitators may decide at any time to no longer provide teaching assistance or Q&A services in association with the content. To be clear, lifetime access is to the course content but not to the facilitator.
Facilitators may not grant licenses to their content to students directly, and any such direct license shall be null and void and a violation of these Terms.
4. Payments, Credits, and Refunds
When you make a payment, you agree to use a valid payment method. If you aren’t happy with your content, Entrepreleaders School offers NO REFUND or credit for ALL content purchases.
Payments
You agree to pay the fees for content that you purchase, and you authorize us to charge your debit or credit card or process other means of payment for those fees. Entrepreleaders School works with payment service providers to offer you the most convenient payment methods in your country and to keep your payment information secure. We may update your payment methods using the information provided by our payment service providers.
When you make a purchase, you agree not to use an invalid or unauthorized payment method. If your payment method fails and you still get access to the content you are enrolling in, you agree to pay us the corresponding fees within thirty (30) days of notification from us. We reserve the right to disable access to any content for which we have not received adequate payment.
5. Gift and Promotional Codes
Entrepreleaders School or our partners may offer gift and promotional codes to students. Certain codes may be redeemed for a gift or promotional credits applied to your Entrepreleaders School account, which then may be used to purchase eligible content on our platform, subject to the terms included with your codes. Other codes may be directly redeemable for specific content. Gift and promotional credits can’t be used for purchases in our mobile or TV applications.
These codes and credits, as well as any promotional value linked to them, may expire if not used within the period specified in your account. Gift and promotional codes offered by may not be refunded for cash, unless otherwise specified in the terms included with your codes or as required by applicable law. Gift and promotional codes offered by a partner are subject to that partner’s refund policies.
If you are a student, the Services enable you to ask questions to the instructors of courses or other content you are enrolled in, and to post reviews of content. For certain content, the instructor may invite you to submit content as “TakeAways” or tests. Don’t post or submit anything that is not yours.
If you are a facilitator, you can submit content for publication on the platform and you can also communicate with the students who have enrolled in your courses or other content. In both cases, you must abide by the law and respect the rights of others: you cannot post any course, question, answer, review or other content that violates applicable local or national laws or regulations of your country. You are solely responsible for any courses, content, and actions you post or take via the platform and Services and their consequences. Make sure you understand all the copyright restrictions set forth in before you submit any content for publication on Entrepreleaders School.
6. Subscription Terms
This section covers additional terms that apply to your use of our subscription-based collections as a student (“Subscription Plans”). By using a Subscription Plan, you agree to the additional terms in this section.
7. Subscription Plans
During your subscription to a Subscription Plan, you get a limited, non-exclusive, non-transferable license from us to access and view the content included in that Subscription Plan via the Services. With the exception of the lifetime access license grant, the terms included in the “Content Enrollment and Lifetime Access” section above apply to enrollments via Subscription Plans.
The subscription that you purchase or renew determines the scope, features, and price of your access to a Subscription Plan. You may not transfer, assign, or share your subscription with anyone else.
We reserve the right to revoke any license to use the content in our Subscription Plans for legal or policy reasons at any time and at our sole discretion, such as if we no longer have the right to offer the content through a Subscription Plan. Additional information on our right to revoke is included in the “Content Enrollment and Lifetime Access” section.
To subscribe to a Subscription Plan, you must provide a payment method. By subscribing to a Subscription Plan and providing your billing information during checkout, you grant us and our payment service providers the right to process payment for the then-applicable fees via the payment method we have on record for you. At the end of each subscription term, we will automatically renew your subscription for the same length of term and process your payment method for payment of the then-applicable fees.
In the event that we update your payment method using the information provided by our payment service providers (as described in the “Payments, Credits”, you authorize us to continue to charge the then-applicable fees to your updated payment method.
If we are unable to process payment through the payment method we have on file for you, or if you file a chargeback disputing charges made to your payment method and the chargeback is granted, we may suspend or terminate your subscription.
We reserve the right to change our Subscription Plans or adjust pricing for our Services at our sole discretion. Any price changes or changes to your subscription will take effect following notice to you, except as otherwise required by applicable law.
8. Subscription Disclaimers
We make no guarantees as to the availability of any specific content in any Subscription Plan or as to any minimum amount of content in any Subscription Plan. At any point in the future, we reserve the right to offer or cease to offer additional features to any Subscription Plan, or to otherwise modify or terminate a Subscription Plan at our sole discretion. These disclaimers are in addition to those listed in the “Disclaimers” section below.
9. Disclaimers
It may happen that our platform is down, either for planned maintenance or because something goes down with the site. It may happen that one of our facilitators is making misleading statements in their content. It may also happen that we encounter security issues. These are just examples. You accept that you will not have any recourse against us in any of these types of cases where things don’t work out right. In legal, more complete language, the Services and their content are provided on an “as is” and “as available” basis. We (and our affiliates, suppliers, partners, and agents) make no representations or warranties about the suitability, reliability, availability, timeliness, security, lack of errors, or accuracy of the Services or their content, and expressly disclaim any warranties or conditions (express or implied), including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We (and our affiliates, suppliers, partners, and agents) make no warranty that you will obtain specific results from use of the Services. Your use of the Services (including any content) is entirely at your own risk. Some jurisdictions don’t allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.
We may decide to cease making available certain features of the Services at any time and for any reason. Under no circumstances will Udemy or its affiliates, suppliers, partners or agents be held liable for any damages due to such interruptions or lack of availability of such features.
We are not responsible for delay or failure of our performance of any of the Services caused by events beyond our reasonable control, like an act of war, hostility, or sabotage; natural disaster; electrical, internet, or telecommunication outage; or government restrictions.
Limitation of Liability
There are risks inherent to using our Services, for example, if you access health and wellness content like yoga, and you injure yourself. You fully accept these risks and you agree that you will have no recourse to seek damages against even if you suffer loss or damage from using our platform and Services.
Indemnification
If you behave in a way that gets us in legal trouble, we may exercise legal recourse against you. You agree to indemnify, defend (if we so request), and hold harmless Entrepreleaders School, our group companies, and their officers, directors, suppliers, partners, and agents from against any third-party claims, demands, losses, damages, or expenses (including reasonable attorney fees) arising from (a) the content you post or submit, (b) your use of the Services (c) your violation of these Terms, or (d) your violation of any rights of a third party. Your indemnification obligation will survive the termination of these Terms and your use of the Services.
No Assignment
You may not assign or transfer these Terms (or the rights and licenses granted under them). For example, if you registered an account as an employee of a company, your account cannot be transferred to another employee. We may assign these Terms (or the rights and licenses granted under them) to another company or person without restriction. Nothing in these Terms confers any right, benefit, or remedy on any third-party person or entity. You agree that your account is non-transferable and that all rights to your account and other rights under these Terms terminate upon your death.
10. Going to Arbitration
If we can’t resolve our dispute amicably, you and Entrepreleaders School agree to resolve any claims related to these Terms (or our other legal terms) through final and binding arbitration, regardless of the type of claim or legal theory. If one of us brings a claim in court that should be arbitrated and the other party refuses to arbitrate it, the other party can ask a court to force us both to go to arbitration (compel arbitration). Either of us can also ask a court to halt a court proceeding while an arbitration proceeding is ongoing.
11. Updating These Terms
From time to time, we may update these Terms to clarify our practices or to reflect new or different practices (such as when we add new features), and Entrepreleaders School reserves the right in its sole discretion to modify and/or make changes to these Terms at any time. If we make any material change, we will notify you using prominent means, such as by email notice sent to the email address specified in your account or by posting a notice through our Services. Modifications will become effective on the day they are posted unless stated otherwise.
Your continued use of our Services after changes become effective shall mean that you accept those changes. Any revised Terms shall supersede all previous Terms.
12. Agreement of Terms of Business
These Terms of Business shall be deemed to have been accepted and agreed by the student or facilitator from the time of using any of Entrepreleaders School’ services.
Our Fees
Fees are charged at R999/70 USD per student every month for the period of 6 months and an optional addition of R1500/80 USD for an extra three months of review after the 6 months (optional). Any late payment fee of more than 7 days without notice will be charged an extra 10% of the initial fee
Entrpreleaders School may alter the fee levels from time to time with at least 3 months’ notice to the students and, if appropriate, will be advised in writing.
13. Paying the Registration fee
The student using accepted into Entrepreleaders School must pay a registration fee of R500 at least 7 days before the start of the program in order to confirm their attendance. No registration fee will be reimbursed once confirmed.
If a student fails to pay an agreed registration fee within 30 days, then Entrepreleaders School reserves the right to cancel the introduction fee and reissue the invoice for the full Global fee listed in our latest brochure or website. A reminder will be sent when the invoice is overdue. If the invoice is still not paid within 7 days and a discount is applied, then a new invoice will be issued with the full fee.
14. Data protection
The School and its facilitators and will use and process personal data for application purposes only and in accordance with EU General Data Protection Regulations.
15. Safeguarding
Entrepreleaders School recognises the importance of safeguarding minors and young people and are committed to taking all reasonable measures to ensure we are adhering to international industry expectations. We provide regular training for our staff and our facilitators.
16. Trademarks
Any of the trademarks, content provided or similar rights that are mentioned, used or cited on the Entrepreleaders School or any other Entrepreleaders related brand and product are the property of their respective owners. Entrepreleaders School DOES NOT grant any rights to use any otherwise protected materials outside of its intended use within the school. Your use of any such or similar incorporeal property in other context that for the purpose of fulfilling the goals of Entrepreleaders School and its interest financially and ethically will be liable of a lawsuit.
Jurisdiction and legality of content
Publication of information found on the Entrepreleaders School website may be in violation of the laws of the country or jurisdiction from where you are viewing this information. Laws in your country or jurisdiction may not protect or allow the same kinds of speech or distribution. Entrepreleaders School does not encourage the violation of any laws; and cannot be responsible for any violations of such laws, should you link to this domain or use, reproduce, or republish the information contained herein.
17. Further details on our Terms
1. Preliminary
You agree to be subject to these Terms whenever you access this website. In addition, by purchasing any of the products on this page you agree that “I have read the Terms of Registered Users and agree with the content” text on the “Terms and conditions” page or the “sign in” page and clicking the ‘Create profile’ button, you (the “Registered student/User”) accept and agree to the additional teacher terms and conditions (found below). Every time you sign in to access this service you confirm your agreement with the Terms.
You agree to guarantee and hold Entrepreleaders School harmless from any loss, claim or damage, including attorney’s fees, arising out of or resulting from your use of the website. This includes any violation of the Terms or any action arising from the content that you publish on the website that infringes the intellectual property rights (which include without limitation copyright, trade secrets, trademark or patent) of any third party or content or communication that denigrates, libels or invades the privacy of any third party.
2. Account and password details
The Registered Student/ User is solely responsible for maintaining the confidentiality of their Registered User name and password.
3. Content
3.1 You alone are responsible for any content or information you enter on your profile page and any communication with other Registered Users and agrees to the accuracy of the content provided. Entrepreleaders School is not the publisher and only provides the channel for Registered Users to publish and/or distribute their personal information.
3.2 Entrepreleaders School does not verify the accuracy or truth of any information published by Registered Users. No responsibility is assumed for the publication of any Registered User’s information, including pictures published by Registered Users.
3.4 Please use your common sense when picking the content that you choose to post on or send via Entrepreleaders School because you are solely responsible for, and bear all liability in relation to, such content. You may not publish offensive content, this includes content that contains offensive language, sexually explicit content (including photographs), is unlawful or libelous. Further, you may not publish content that encourages behaviour that may constitute a criminal offence, result in civil liability or otherwise violate any applicable local, state, national or international law or regulation. For example, you may not post or send any content on the Teacher Horizons website which:
- is obscene, pornographic or otherwise may offend human dignity;
- is abusive, insulting or threatening, or which promotes or encourages racism, sexism, hatred or bigotry;
- incorporates the image or likeness of any individual under 18 years of age;
- encourages any illegal activity including, without limitation, terrorism, inciting racial hatred or the submission of which in itself constitutes committing a criminal offence;
- is defamatory;
- relates to commercial activities (including, without limitation, sales, competitions and advertising, links to other websites or premium line telephone numbers);
- involves the transmission of “junk” mail or “spam”;
- contains any spyware, adware, viruses, corrupt files, worm programmes or other malicious code designed to interrupt, damage or limit the functionality of or disrupt any software, hardware, telecommunications, networks, servers or other equipment, Trojan horse or any other material designed to damage, interfere with, wrongly intercept or expropriate any data or personal information whether from Teacher Horizons or otherwise; or
- itself, or the posting of which, infringes any third party’s rights (including, without limitation, intellectual property rights and privacy rights).
3.5 Please note though that by posting or sending content on the website you represent and warrant to us that you have the right to do so, and automatically grant to us a non-exclusive, royalty-free, perpetual, worldwide licence to use such content in any way (including, without limitation, editing, copying, modifying, adapting, translating, reformatting, creating derivative works from, incorporating into other works, advertising, distributing and otherwise making available to the general public such content, whether in whole or in part and in any format or medium currently known or developed in the future). We may assign and/or sub-licence the above licence to our affiliates and successors without any further approval by you. By submitting content to the website you are warranting that you are the exclusive author and owner of that content and you agree that you waive any and all moral rights relating to that content (including, without limitation, the right to be identified as the author). We have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to our website constitutes a violation of their intellectual property rights or of their right to privacy or any other law.
3.6 Whilst Entrepreleaders School reserves the right to delete or remove content deemed offensive, we do not guarantee that offensive material will be removed or deleted. Failure to remove or delete offensive content does not waive our right to remove or delete offensive content in subsequent or similar cases.
3.7 You may not publish content that contains advertising or commercial messages. You may not send messages of a commercial nature to other Registered Users via the site.
3.8 Teacher Horizons reserves the right to refuse to accept, applications, post, display or transmit any user content in its sole discretion.
3.9 You may not impersonate any other person or entity.
3.10 You may not solicit other Registered Users’ contact details.
3.11 By creating a profile you grant Entrepreleaders School permission to publish your profile (including picture) on www.entrepreleadersschool.co.za
3.12 Your picture and extracts from your profile may be used as a ‘featured profile’ for marketing purposes (on the homepage of Entrepreleaders School or in our brochures or other marketing materials)
3.13 Entrepreleaders School reserves the right to be able to use screenshots or similar images of pages featured throughout our service, including the Registered User screen name and photo(s) and use these for general promotional purposes, for example, but not limited to, a corporate brochure, Registered User communications. By creating a profile you grant Teacher Horizons permission to publish your profile in such a fashion.
18. Copyrighted material
You may not post material belonging to a third party on the site without permission from them. This includes but is not limited to photographs, images and text. Should you believe that material belonging to a third party has been posted on the site you are requested to contact Entrepreleaders School via our students email students@entrepreleaders.co.za with full details of the alleged copyright infringement including the Registered User username and your contact details.
19. Registered Users, subscriptions and cancellations
19.1 In order to register on the Entrepreleders School website you must be either an established entrepreneur with facilitating skills or an aspiring youth entrepreneur.
19.2 You may register your profile for free and will have access to most of our services. Subscription charges are levied to gain full access to the service for schools, including but not limited to the ability to contact facilitators. Subscription is entirely voluntary and you may remain a free Registered User as long as you wish. There are no subscription charges for facilitators.
19.3 Teacher Horizons may change the subscription pricing, options, renewal terms or Registered User services at any time. The Registered User may cancel their subscription at any time. School subscription fees are not transferable from one Registered User profile to another.
19.4 ELS (Entrepreleaders School) may suspend or terminate the subscription of any Registered User who violates these terms.
19.5 ELS reserves the right not to accept or to suspend or remove from the site all or part of any profile or any other Registered user content for any reason.
19.6 Registered facilitators, users and school users must not publish on your profile any personal contact information, including your address, email address, telephone number, instant messaging contact details or website URL in areas other than the requested fields. In addition, you must not include your personal contact information in messages to members who have not previously contacted you. Teacher Horizons reserves the right to remove contact details from messages you send on the Teacher Horizons website.
19.7 Refunds, discounts on subscriptions for once-off or annual subscriptions will be given to students at the discretion of ELS management.
20. Rights of third parties
A person who is not a party to this agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to rely upon or enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.
21. Severability
If any provision in these Terms is deemed to be invalid or unenforceable for any reason, the remaining provisions will continue in full force without being impaired or invalidated in any way.
ANYONE IN BREACH OF THE RIGHTS OVER THIS SCHOOL CONTENT WILL BE CHARGED TO THE FULLEST EXTENT POSSIBLE BY LAW, ENTREPRELEADERS SCHOOL; MAXIMUM LIABILITY ARISING OUT OF OR IN CONNECTION WITH ANY ENTREPRELEADERS SITE OR YOUR USE OF THE ENTREPRELEADERS CONTENT, REGARDLESS OF THE CAUSE OF ACTION (WHETHER IN CONTRACT, TORT, BREACH OF WARRANTY OR OTHERWISE), WILL NOT EXCEED R10 000.
